    When we use the term “personal information,” we refer to information that identifies you or another person, or that can be directly associated with you. Personal information does not include information that has been collected anonymously or anonymized in such a way that identification or association with your person is not possible. • From our partners and other third-party providers

    How do we use your personal information?

    Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

    • Providing, customizing, and improving the Services. We use your personal information to provide the Services to you. This includes, among other things, fulfilling our contract with you, processing your payments, executing your orders, storing your configurations and the items you are interested in, sending notifications related to your account, creating, maintaining, and otherwise managing your account, organizing shipping, facilitating returns and exchanges, enabling you to submit reviews, and creating a personalized shopping experience for you, for example, by recommending products based on your purchases. Under these circumstances, Shopify is responsible for the processing of your personal information, including responding to your requests to exercise your rights regarding the use of your personal information for these purposes. Further information on how Shopify uses your personal information and what rights you have can be found in the Shopify Privacy Policy for Consumers. The inclusion of such links by us does not mean that we endorse the content of these platforms or their owners or operators, unless expressly stated in the Services.

    Children's data

    The Services are not intended for use by children, and we do not knowingly collect personal information from children who have not yet reached the age of majority in your country. If you are the parent or guardian of a child who has provided us with their personal information, you can contact us using the contact details provided below to request the deletion of this data. Security and retention of your data

    Please note that no security measures are perfect or impenetrable, and therefore we cannot guarantee “perfect security.” Furthermore, information you send to us may be exposed to risks during transmission. We recommend that you do not use insecure channels when transmitting sensitive or confidential information to us.

    • Right to object and right to restriction of processing. You may have the right to request that we stop or restrict the processing of personal information for certain purposes.
    • Withdrawal of consent. Insofar as we rely on consent to process your personal information, you have the right to withdraw this consent. If you withdraw your consent, this does not affect the lawfulness of processing based on your consent before its withdrawal.

    Exercising these rights will not result in any disadvantages for you. To the extent permitted or required by applicable law, we may need to verify your identity before we can process your requests. In accordance with applicable laws, you may designate an authorized agent to make requests to exercise your rights on your behalf. Before we accept such a request from an agent, we will require them to provide proof that you have authorized them to act on your behalf. It may be necessary for you to confirm your identity directly with us. We will respond to your request promptly within the framework of applicable law.

    Complaints

    If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you reside, you have the right to appeal our decision by contacting us using the contact details provided below or by filing your complaint with the competent data protection authority. Changes to this Privacy Policy

    We may update this privacy policy from time to time, for example, to reflect changes in our practices, or for other operational, legal, or regulatory reasons. We will post the revised privacy policy on this website, update the “Last updated” date accordingly, and provide notice as required by applicable law.

    Contact

    If you have any questions about our privacy practices or this privacy policy, or if you would like to exercise any of the rights to which you are entitled, please contact us by email at info@muwana.de or by mail at Paul-Wagner-Str. 49a, 64285 Darmstadt, DE. A. General Terms and Conditions

    1 Scope, Provider
    (1) These General Terms and Conditions apply exclusively to all contracts for the supply of goods and the provision of services between Carla Patricia Rachinas Penim, 64295 Darmstadt, (hereinafter referred to as “Seller” or “Provider”) and the respective customer (hereinafter referred to as “Customer”) via all distribution channels.

    5 Delivery and shipping costs
    (1) In addition to the final price according to § 4, delivery and shipping costs will be charged unless otherwise stated in the product offers.
    (2) The Customer can obtain information about the delivery and shipping costs in advance via the following link: https://muwana.de

    6 Terms of delivery and reservation of self-supply
    (1) Delivery is carried out by involving delivery companies. As a rule, DHL or DPD are commissioned.
    (2) The delivery time is stated for the respective item and is non-binding.
    (3) Should not all ordered products be in stock, the Seller is entitled to make partial deliveries at their own expense, insofar as this is reasonable for the Customer.
    (4) Should the delivery of the goods fail through the fault of the Customer despite three delivery attempts, the Seller has the right to withdraw from the contract. Any payments already made will be refunded immediately.
    (5) If the ordered product is not available because the Seller has not been supplied with this product by their suppliers through no fault of their own, the Seller may withdraw from the contract. Pre-notification is any communication (e.g., invoice, policy, contract) to the Customer that announces a charge via SEPA direct debit. If the direct debit is not honored due to insufficient funds or due to the provision of incorrect bank details, or if the Customer objects to the debit, although they are not entitled to do so, the Customer shall bear the fees incurred by the return debit of the respective credit institution, provided they are responsible for this.
    ShopPay
    Provider: Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland

    8 Retention of title
    Insofar as the Seller performs in advance, they reserve ownership until full payment. Before the transfer of ownership, pledging, transfer by way of security, processing, or modification is not permitted without our consent.

    (1) The Customer must provide truthful information about their age during the ordering process.
    (2) The Customer must provide exclusively truthful information regarding their master data (esp. name, address, means of communication) and payment data (esp. account details) and keep them up to date until completion of the transaction, including the expiry of the warranty periods. If master data changes after the order is completed, the Customer must inform the Seller of the change immediately.
    (3) The Customer must ensure that the email address provided for order processing is correct so that emails sent by the Seller can be received at this address. In particular, when using SPAM filters, the Customer must ensure that all emails sent by the Seller or third parties commissioned by the Seller to process the order can be delivered.

    (1) If goods are delivered with obvious transport damage, please report such errors immediately to the deliverer and contact us as soon as possible (email to info@muwana.de).
    (2) Failing to report or contact us has no consequences for your statutory warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

    12 Force majeure
    (1) In the event of force majeure events that affect the fulfillment of the contract, the Seller is entitled to postpone the delivery for the duration of the hindrance and, in the event of longer-term delays, to withdraw from the contract in whole or in part, without any claims against the Seller being derived therefrom.
    (2) The following events in particular are considered force majeure:
    • Floods;
    • Earthquakes;
    • Natural disasters;
    • Storms;

    13 Warranty for the sale of goods

    The warranty is provided in accordance with the statutory provisions.

    14 Liability
    (1) The Seller is liable to the Customer for all contractual, quasi-contractual, and statutory claims, including tortious claims for damages and reimbursement of expenses as follows:
    (2) The Seller is liable without limitation on any legal ground:
    - in the event of intent or gross negligence,
    - in the event of intentional or negligent injury to life, body, or health,
    - due to a guarantee promise, unless otherwise regulated in this regard,
    - due to mandatory liability such as under the Product Liability Act.
    (3) If the Seller negligently violates a material contractual obligation, liability is limited to the foreseeable damage typical for the contract, unless liability is unlimited according to the preceding paragraph. Material contractual obligations are obligations which the contract imposes on the Seller according to its content to achieve the purpose of the contract, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the Customer may regularly rely.
    (4) Otherwise, any liability of the Seller is excluded.
    (5) The above liability provisions also apply with regard to the Seller's liability for their vicarious agents and legal representatives.

    15 Data protection
    (1) The Seller collects and processes the Customer's personal data to carry out the order.
    (2) Further information on the handling of personal data by the Seller can be found in the data protection information at https://muwana.de

    16 Choice of law, place of performance, place of jurisdiction
    (1) For all legal relationships between the Seller and the Buyer arising from and in connection with these General Terms and Conditions, the law of the Federal Republic of Germany applies exclusively, excluding the UN Sales Convention (CISG). For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
    (2) The place of performance for the Seller's services is their place of business.
    (3) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is the Seller's place of business. The same applies if the Customer has no general place of jurisdiction in Germany or the EU or if their residence or habitual place of abode is not known at the time the action is filed. The authority to also call upon the court at another statutory place of jurisdiction remains unaffected.

    Instructions on withdrawal
    Right of withdrawal

    To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

    Please click on "Withdraw from contract" below.

You must send back or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

    We will bear the cost of returning the goods.

    Information on the Battery Act

    Notes on battery disposal

    In connection with the sale of batteries or the delivery of devices containing batteries, we are required to draw your attention to the following:

    1. Free return of waste batteries Batteries must not be disposed of with household waste. You are legally obligated to return waste batteries to ensure proper disposal. You can return waste batteries free of charge to a municipal collection point or to a local retailer. As a distributor of batteries, we are also obligated to take back waste batteries, although our obligation is limited to waste batteries of the type that we carry or have carried in our range as new batteries. You can therefore send waste batteries of the aforementioned type back to us with sufficient postage.

    2. Meaning of the battery symbols: Batteries are marked with the symbol of a crossed-out wheeled bin.

    This symbol indicates that batteries must not be disposed of with household waste. For batteries containing more than 0.0005 percent by mass of mercury, more than 0.002 percent by mass of cadmium, or more than 0.004 percent by mass of lead, the chemical name of the pollutant used is indicated below the bin symbol:

    • Pb: Battery contains lead
    • Cd: Battery contains cadmium
    • Hg: Battery contains mercury
