3 Conclusion of contract for orders via the online shop
(1) The product presentations in the online shop constitute binding offers by the Seller. By clicking the “Buy” button, the Customer accepts the offer in a binding manner.
(2) After receipt of the Customer's order by the Seller, the Customer will receive an order confirmation via email.

4 Prices
The prices stated on the product pages include statutory VAT and other price components and are final prices plus delivery and shipping costs according to § 5.

5 Delivery and shipping costs
(1) In addition to the final price according to § 4, delivery and shipping costs will be charged unless otherwise stated in the product offers.
(2) The Customer can obtain information about the delivery and shipping costs in advance via the following link: https://muwana.de

6 Terms of delivery and reservation of self-supply
(1) Delivery is carried out by involving delivery companies. As a rule, DHL or DPD are commissioned.
(2) The delivery time is stated for the respective item and is non-binding.
(3) Should not all ordered products be in stock, the Seller is entitled to make partial deliveries at their own expense, insofar as this is reasonable for the Customer.
(4) Should the delivery of the goods fail through the fault of the Customer despite three delivery attempts, the Seller has the right to withdraw from the contract. Any payments already made will be refunded immediately.
(5) If the ordered product is not available because the Seller has not been supplied with this product by their suppliers through no fault of their own, the Seller may withdraw from the contract. In this case, the Customer will be informed immediately and, if applicable, the delivery of a comparable product will be suggested. If no comparable product is available or if the Customer does not wish for a comparable product to be delivered, any consideration already provided will be refunded immediately.

7 Terms of payment

9 Obligations of the Customer
(1) The Customer must provide truthful information about their age during the ordering process.
(2) The Customer must provide exclusively truthful information regarding their master data (esp. name, address, means of communication) and payment data (esp. account details) and keep them up to date until completion of the transaction, including the expiry of the warranty periods. If master data changes after the order is completed, the Customer must inform the Seller of the change immediately.
(3) The Customer must ensure that the email address provided for order processing is correct so that emails sent by the Seller can be received at this address. In particular, when using SPAM filters, the Customer must ensure that all emails sent by the Seller or third parties commissioned by the Seller to process the order can be delivered.

10 Right of withdrawal for consumers
(1) Consumers are entitled to a statutory right of withdrawal. Further details can be found in the cancellation policy at https://muwana.de.
(2) Exceptions to the statutory right of withdrawal are listed under B. 5.

11 Transport damage
(1) If goods are delivered with obvious transport damage, please report such errors immediately to the deliverer and contact us as soon as possible (email to info@muwana.de).
(2) Failing to report or contact us has no consequences for your statutory warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

12 Force majeure
(1) In the event of force majeure events that affect the fulfillment of the contract, the Seller is entitled to postpone the delivery for the duration of the hindrance and, in the event of longer-term delays, to withdraw from the contract in whole or in part, without any claims against the Seller being derived therefrom.
(2) The following events in particular are considered force majeure:
‱ Floods;
‱ Earthquakes;
‱ Natural disasters;
‱ Storms;
‱ Hurricanes;
‱ Fires;
‱ Wars and civil wars;
‱ Revolutions;
‱ Embargoes and calls for boycotts;

(2) The Seller is liable without limitation on any legal ground:
- in the event of intent or gross negligence,
- in the event of intentional or negligent injury to life, body, or health,
- due to a guarantee promise, unless otherwise regulated in this regard,
- due to mandatory liability such as under the Product Liability Act.
(3) If the Seller negligently violates a material contractual obligation, liability is limited to the foreseeable damage typical for the contract, unless liability is unlimited according to the preceding paragraph. Material contractual obligations are obligations which the contract imposes on the Seller according to its content to achieve the purpose of the contract, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the Customer may regularly rely.
(4) Otherwise, any liability of the Seller is excluded.
(5) The above liability provisions also apply with regard to the Seller's liability for their vicarious agents and legal representatives.

15 Data protection
(1) The Seller collects and processes the Customer's personal data to carry out the order.
(2) Further information on the handling of personal data by the Seller can be found in the data protection information at https://muwana.de

16 Choice of law, place of performance, place of jurisdiction
(1) For all legal relationships between the Seller and the Buyer arising from and in connection with these General Terms and Conditions, the law of the Federal Republic of Germany applies exclusively, excluding the UN Sales Convention (CISG). For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) The place of performance for the Seller's services is their place of business.
(3) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is the Seller's place of business. The same applies if the Customer has no general place of jurisdiction in Germany or the EU or if their residence or habitual place of abode is not known at the time the action is filed. The authority to also call upon the court at another statutory place of jurisdiction remains unaffected.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive the notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is the earliest. You must send back or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

We will bear the cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Notes on battery disposal

In connection with the sale of batteries or the delivery of devices containing batteries, we are required to draw your attention to the following:

1. Free return of waste batteries Batteries must not be disposed of with household waste. You are legally obligated to return waste batteries to ensure proper disposal. You can return waste batteries free of charge to a municipal collection point or to a local retailer. As a distributor of batteries, we are also obligated to take back waste batteries, although our obligation is limited to waste batteries of the type that we carry or have carried in our range as new batteries. You can therefore send waste batteries of the aforementioned type back to us with sufficient postage.

2. Meaning of the battery symbols: Batteries are marked with the symbol of a crossed-out wheeled bin.

This symbol indicates that batteries must not be disposed of with household waste. For batteries containing more than 0.0005 percent by mass of mercury, more than 0.002 percent by mass of cadmium, or more than 0.004 percent by mass of lead, the chemical name of the pollutant used is indicated below the bin symbol:

  • Pb: Battery contains lead
  • Cd: Battery contains cadmium
  • Hg: Battery contains mercury
