What personal information do we collect or process?

When we use the term “personal information,” we refer to information that identifies you or another person, or that can be directly associated with you. How do we use your personal information?

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

Providing, customizing, and improving the Services. We use your personal information to provide the Services to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activities across different merchants and websites. Our business and marketing partners use your data in accordance with their own privacy policies. Depending on where you live, you may have the right to direct us not to share information about you to show you targeted advertising and marketing based on your online activities across different merchants and websites.
When you request or otherwise give your consent for us to share certain information with third parties, for example, to deliver products to you, or when you use social media widgets or login integrations.
We share personal information with our affiliates or otherwise within our corporate group.
In connection with a business transaction such as a merger or bankruptcy, to comply with applicable legal obligations (including responding to subpoenas, search warrants, and similar requests), to enforce applicable Terms of Service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, whereby Shopify collects and processes personal information regarding your access to and use of the Services to provide and improve the Services for you. To provide these advanced features, Shopify may use personal information collected through your interactions with our shop, other merchants, and Shopify. Under these circumstances, Shopify is responsible for the processing of your personal information, including responding to your requests to exercise your rights regarding the use of your personal information for these purposes. Further information on how Shopify uses your personal information and what rights you have can be found in the Shopify Privacy Policy for Consumers. Depending on where you reside, you can exercise certain rights regarding your personal information listed here Link to the Shopify Privacy Portal.

Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to websites that are not affiliate websites or not controlled by us, you should review their privacy and security policies as well as other terms and conditions. We provide no guarantee and are not responsible for the privacy or security of such websites, including the accuracy, completeness, or reliability of the information contained on those websites. Information you provide in public or semi-public areas, including information you share on third-party social networking platforms, may also be viewed by other users of the Services and/or users of those third-party platforms, without limitations regarding their use by us or by a third party. The inclusion of such links by us does not mean that we endorse the content of these platforms or their owners or operators, unless expressly stated in the Services.

Children's data

The Services are not intended for use by children, and we do not knowingly collect personal information from children who have not yet reached the age of majority in your country. If you are the parent or guardian of a child who has provided us with their personal information, you can contact us using the contact details provided below to request the deletion of this data. We recommend that you do not use insecure channels when transmitting sensitive or confidential information to us.

How long we retain your personal information depends on various factors. These include, for example, whether we need the data to manage your account, provide you with services, comply with legal obligations, resolve disputes, or enforce other applicable contracts and policies.

Right of access/information. You may have the right to request access to the personal information we hold about you.
Right to deletion. You may have the right to request that we delete the personal information we hold about you.
Right to rectification. You may have the right to request that we correct inaccurate personal information we hold about you.
Right to data portability. You may have the right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party under certain circumstances and with certain exceptions.
Managing communication settings. We may send you promotional emails. You can object to receiving these emails at any time by using the unsubscribe option contained in our emails to you. If you choose to opt-out, we may continue to send you non-promotional emails, such as regarding your account or orders you have placed.

If you reside in the United Kingdom or the European Economic Area, subject to exceptions and limitations under local law, you may exercise the following rights in addition to the rights mentioned above:

Right to object and right to restriction of processing. You may have the right to request that we stop or restrict the processing of personal information for certain purposes.
Withdrawal of consent. Insofar as we rely on consent to process your personal information, you have the right to withdraw this consent. If you withdraw your consent, this does not affect the lawfulness of processing based on your consent before its withdrawal.

In accordance with applicable laws, you may designate an authorized agent to make requests to exercise your rights on your behalf. Before we accept such a request from an agent, we will require them to provide proof that you have authorized them to act on your behalf. It may be necessary for you to confirm your identity directly with us. We will respond to your request promptly within the framework of applicable law.

Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you reside, you have the right to appeal our decision by contacting us using the contact details provided below or by filing your complaint with the competent data protection authority. Changes to this Privacy Policy

We may update this privacy policy from time to time, for example, to reflect changes in our practices, or for other operational, legal, or regulatory reasons. We will post the revised privacy policy on this website, update the “Last updated” date accordingly, and provide notice as required by applicable law.

3 Conclusion of contract for orders via the online shop
(1) The product presentations in the online shop constitute binding offers by the Seller. By clicking the “Buy” button, the Customer accepts the offer in a binding manner.
(2) After receipt of the Customer's order by the Seller, the Customer will receive an order confirmation via email.

4 Prices
The prices stated on the product pages include statutory VAT and other price components and are final prices plus delivery and shipping costs according to § 5.

5 Delivery and shipping costs
(1) In addition to the final price according to § 4, delivery and shipping costs will be charged unless otherwise stated in the product offers.
(2) The Customer can obtain information about the delivery and shipping costs in advance via the following link: https://muwana.de

6 Terms of delivery and reservation of self-supply
(1) Delivery is carried out by involving delivery companies. As a rule, DHL or DPD are commissioned.
(2) The delivery time is stated for the respective item and is non-binding.
(3) Should not all ordered products be in stock, the Seller is entitled to make partial deliveries at their own expense, insofar as this is reasonable for the Customer.
(4) Should the delivery of the goods fail through the fault of the Customer despite three delivery attempts, the Seller has the right to withdraw from the contract. Any payments already made will be refunded immediately.
(5) If the ordered product is not available because the Seller has not been supplied with this product by their suppliers through no fault of their own, the Seller may withdraw from the contract. In this case, the Customer will be informed immediately and, if applicable, the delivery of a comparable product will be suggested. If no comparable product is available or if the Customer does not wish for a comparable product to be delivered, any consideration already provided will be refunded immediately.

7 Terms of payment

9 Obligations of the Customer
(1) The Customer must provide truthful information about their age during the ordering process.
(2) The Customer must provide exclusively truthful information regarding their master data (esp. name, address, means of communication) and payment data (esp. account details) and keep them up to date until completion of the transaction, including the expiry of the warranty periods. If master data changes after the order is completed, the Customer must inform the Seller of the change immediately.
(3) The Customer must ensure that the email address provided for order processing is correct so that emails sent by the Seller can be received at this address. In particular, when using SPAM filters, the Customer must ensure that all emails sent by the Seller or third parties commissioned by the Seller to process the order can be delivered.

12 Force majeure
(1) In the event of force majeure events that affect the fulfillment of the contract, the Seller is entitled to postpone the delivery for the duration of the hindrance and, in the event of longer-term delays, to withdraw from the contract in whole or in part, without any claims against the Seller being derived therefrom.
(2) The following events in particular are considered force majeure:
• Floods;
• Earthquakes;
• Natural disasters;
• Storms;
• Hurricanes;
• Fires;
• Wars and civil wars;
• Revolutions;
• Embargoes and calls for boycotts;
• Pandemics
13 Warranty for the sale of goods

The warranty is provided in accordance with the statutory provisions.

14 Liability
(1) The Seller is liable to the Customer for all contractual, quasi-contractual, and statutory claims, including tortious claims for damages and reimbursement of expenses as follows:
(2) The Seller is liable without limitation on any legal ground:
- in the event of intent or gross negligence,
- in the event of intentional or negligent injury to life, body, or health,
- due to a guarantee promise, unless otherwise regulated in this regard,
- due to mandatory liability such as under the Product Liability Act.
(3) If the Seller negligently violates a material contractual obligation, liability is limited to the foreseeable damage typical for the contract, unless liability is unlimited according to the preceding paragraph. Material contractual obligations are obligations which the contract imposes on the Seller according to its content to achieve the purpose of the contract, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the Customer may regularly rely.
(4) Otherwise, any liability of the Seller is excluded.
(5) The above liability provisions also apply with regard to the Seller's liability for their vicarious agents and legal representatives.

15 Data protection
(1) The Seller collects and processes the Customer's personal data to carry out the order.
(2) Further information on the handling of personal data by the Seller can be found in the data protection information at https://muwana.de

16 Choice of law, place of performance, place of jurisdiction
(1) For all legal relationships between the Seller and the Buyer arising from and in connection with these General Terms and Conditions, the law of the Federal Republic of Germany applies exclusively, excluding the UN Sales Convention (CISG). For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) The place of performance for the Seller's services is their place of business.
(3) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is the Seller's place of business. The same applies if the Customer has no general place of jurisdiction in Germany or the EU or if their residence or habitual place of abode is not known at the time the action is filed. The authority to also call upon the court at another statutory place of jurisdiction remains unaffected.

The following information on the right of withdrawal applies only to consumers, i.e., natural persons who enter into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (§ 13 BGB).

Instructions on withdrawal
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have/has taken possession of the last goods.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Please click on "Withdraw from contract" below.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive the notice of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is the earliest. The deadline is met if you send back the goods before the period of fourteen days has expired.

Information on the Battery Act

Notes on battery disposal

In connection with the sale of batteries or the delivery of devices containing batteries, we are required to draw your attention to the following:

1. Free return of waste batteries Batteries must not be disposed of with household waste. You are legally obligated to return waste batteries to ensure proper disposal. You can return waste batteries free of charge to a municipal collection point or to a local retailer. As a distributor of batteries, we are also obligated to take back waste batteries, although our obligation is limited to waste batteries of the type that we carry or have carried in our range as new batteries. You can therefore send waste batteries of the aforementioned type back to us with sufficient postage.

2. Meaning of the battery symbols: Batteries are marked with the symbol of a crossed-out wheeled bin.

This symbol indicates that batteries must not be disposed of with household waste. For batteries containing more than 0.0005 percent by mass of mercury, more than 0.002 percent by mass of cadmium, or more than 0.004 percent by mass of lead, the chemical name of the pollutant used is indicated below the bin symbol:

Pb: Battery contains lead
Cd: Battery contains cadmium
Hg: Battery contains mercury
