Muwana operates this shop and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a personalized shopping experience (the “Services”). Muwana is powered by Shopify, which enables us to provide the Services to you. This privacy policy describes how we collect, use, or disclose personal information when you visit, use, or make a purchase or other transaction using the Services, or otherwise communicate with us. If there is a conflict between our Terms and Conditions and this Privacy Policy, this Privacy Policy takes precedence regarding the collection, processing, and disclosure of your personal information.

Please read this privacy policy carefully. By using and accessing any of the Services, you acknowledge that you have read this privacy policy and agree to the collection, use, and disclosure of your information as described in this privacy policy.

What personal information do we collect or process?

When we use the term “personal information,” we refer to information that identifies you or another person, or that can be directly associated with you. Personal information does not include information that has been collected anonymously or anonymized in such a way that identification or association with your person is not possible. Depending on how you interact with the Services, where you live, and as permitted or required by applicable law, we may collect or process the following categories of personal information, including inferences drawn from this personal information:

We may collect personal information from the following sources:

Directly from you We collect the information when, among other things, you create an account, access or use the Services, communicate with us, or otherwise provide us with your personal information.
Automatically through the Services We collect the information from your device, when you use our products or services, or visit our website, as well as through the use of cookies and similar technologies.
From our service providers We collect the information when, among other things, we engage service providers to enable certain technologies, and when they collect or process your personal information on our behalf.
From our partners and other third-party providers

How do we use your personal information?

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

Providing, customizing, and improving the Services. We use your personal information to provide the Services to you. This includes, among other things, fulfilling our contract with you, processing your payments, executing your orders, storing your configurations and the items you are interested in, sending notifications related to your account, creating, maintaining, and otherwise managing your account, organizing shipping, facilitating returns and exchanges, enabling you to submit reviews, and creating a personalized shopping experience for you, for example, by recommending products based on your purchases. This may also include using your personal information to better customize and improve the Services.

Legal reasons. We use your personal information to comply with applicable law or respond to lawful legal processes, including requests from law enforcement or regulatory authorities, to investigate or participate in civil investigations, potential or actual litigation, or other adversarial proceedings, and to investigate or enforce potential violations of our terms or policies.

How do we share personal information?

Under certain circumstances, we may share your personal information with third parties for legitimate purposes in accordance with this privacy policy. Such circumstances may include the following:

With Shopify, these are vendors and other third parties that provide services on our behalf (e.g., IT management, payment processing, data analysis, customer support, cloud storage, fulfillment, and shipping).

For example, we use Shopify to support personalized advertising with third-party services based on your online activities across different merchants and websites. Our business and marketing partners use your data in accordance with their own privacy policies. Depending on where you live, you may have the right to direct us not to share information about you to show you targeted advertising and marketing based on your online activities across different merchants and websites.
When you request or otherwise give your consent for us to share certain information with third parties, for example, to deliver products to you, or when you use social media widgets or login integrations.
We share personal information with our affiliates or otherwise within our corporate group.
In connection with a business transaction such as a merger or bankruptcy, to comply with applicable legal obligations (including responding to subpoenas, search warrants, and similar requests), to enforce applicable Terms of Service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, whereby Shopify collects and processes personal information regarding your access to and use of the Services to provide and improve the Services for you. Data you submit to the Services is shared with Shopify as well as with third parties, which may be located in countries other than your country of residence, to provide and improve the Services for you. To protect, grow, and improve our business, we also use certain advanced Shopify features that include data and information from your interactions with our shop, with other merchants, and with Shopify. To provide these advanced features, Shopify may use personal information collected through your interactions with our shop, other merchants, and Shopify. Under these circumstances, Shopify is responsible for the processing of your personal information, including responding to your requests to exercise your rights regarding the use of your personal information for these purposes. Further information on how Shopify uses your personal information and what rights you have can be found in the Shopify Privacy Policy for Consumers. Depending on where you reside, you can exercise certain rights regarding your personal information listed here Link to the Shopify Privacy Portal.

Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to websites that are not affiliate websites or not controlled by us, you should review their privacy and security policies as well as other terms and conditions. We provide no guarantee and are not responsible for the privacy or security of such websites, including the accuracy, completeness, or reliability of the information contained on those websites. Information you provide in public or semi-public areas, including information you share on third-party social networking platforms, may also be viewed by other users of the Services and/or users of those third-party platforms, without limitations regarding their use by us or by a third party. The inclusion of such links by us does not mean that we endorse the content of these platforms or their owners or operators, unless expressly stated in the Services.

Children's data

The Services are not intended for use by children, and we do not knowingly collect personal information from children who have not yet reached the age of majority in your country. If you are the parent or guardian of a child who has provided us with their personal information, you can contact us using the contact details provided below to request the deletion of this data. At the time this privacy policy takes effect, we have no knowledge of "sharing" or "selling" (as defined by applicable law) any personal information of individuals under 16 years of age.

We recommend that you do not use insecure channels when transmitting sensitive or confidential information to us.

How long we retain your personal information depends on various factors. These include, for example, whether we need the data to manage your account, provide you with services, comply with legal obligations, resolve disputes, or enforce other applicable contracts and policies.

Your rights and choices

Depending on where you reside, you may have some or all of the rights listed below regarding your personal information. However, these rights are not absolute, may only apply under certain circumstances, and in certain cases, we may refuse your request to the extent permitted by law.

Right of access/information. You may have the right to request access to the personal information we hold about you.
Right to deletion. You may have the right to request that we delete the personal information we hold about you.
Right to rectification. You may have the right to request that we correct inaccurate personal information we hold about you.
Right to data portability. You may have the right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party under certain circumstances and with certain exceptions.
Managing communication settings. We may send you promotional emails. You can object to receiving these emails at any time by using the unsubscribe option contained in our emails to you. If you choose to opt-out, we may continue to send you non-promotional emails, such as regarding your account or orders you have placed.

If you reside in the United Kingdom or the European Economic Area, subject to exceptions and limitations under local law, you may exercise the following rights in addition to the rights mentioned above:

Right to object and right to restriction of processing. You may have the right to request that we stop or restrict the processing of personal information for certain purposes.
Withdrawal of consent. Insofar as we rely on consent to process your personal information, you have the right to withdraw this consent. If you withdraw your consent, this does not affect the lawfulness of processing based on your consent before its withdrawal.

You can exercise these rights if indicated accordingly in the Services, or by contacting us using the contact details provided below. In accordance with applicable laws, you may designate an authorized agent to make requests to exercise your rights on your behalf. Before we accept such a request from an agent, we will require them to provide proof that you have authorized them to act on your behalf. It may be necessary for you to confirm your identity directly with us. We will respond to your request promptly within the framework of applicable law.

Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you reside, you have the right to appeal our decision by contacting us using the contact details provided below or by filing your complaint with the competent data protection authority. Please note that we may transfer, store, and process your personal information outside the country in which you reside.

When we transfer your personal information outside the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission’s Standard Contractual Clauses or equivalent contracts issued by the relevant authority of the United Kingdom, unless the data transfer is to a country that is proven to provide an adequate level of protection.

Changes to this Privacy Policy

We may update this privacy policy from time to time, for example, to reflect changes in our practices, or for other operational, legal, or regulatory reasons. We will post the revised privacy policy on this website, update the “Last updated” date accordingly, and provide notice as required by applicable law.

3 Conclusion of contract for orders via the online shop
(1) The product presentations in the online shop constitute binding offers by the Seller. By clicking the “Buy” button, the Customer accepts the offer in a binding manner.
(2) After receipt of the Customer's order by the Seller, the Customer will receive an order confirmation via email.

4 Prices
The prices stated on the product pages include statutory VAT and other price components and are final prices plus delivery and shipping costs according to § 5.

5 Delivery and shipping costs
(1) In addition to the final price according to § 4, delivery and shipping costs will be charged unless otherwise stated in the product offers.
(2) The Customer can obtain information about the delivery and shipping costs in advance via the following link: https://muwana.de

6 Terms of delivery and reservation of self-supply
(1) Delivery is carried out by involving delivery companies. As a rule, DHL or DPD are commissioned.
(2) The delivery time is stated for the respective item and is non-binding.
(3) Should not all ordered products be in stock, the Seller is entitled to make partial deliveries at their own expense, insofar as this is reasonable for the Customer.
(4) Should the delivery of the goods fail through the fault of the Customer despite three delivery attempts, the Seller has the right to withdraw from the contract. Any payments already made will be refunded immediately.
(5) If the ordered product is not available because the Seller has not been supplied with this product by their suppliers through no fault of their own, the Seller may withdraw from the contract. In this case, the Customer will be informed immediately and, if applicable, the delivery of a comparable product will be suggested. If no comparable product is available or if the Customer does not wish for a comparable product to be delivered, any consideration already provided will be refunded immediately.

7 Terms of payment

(2) The Customer must provide exclusively truthful information regarding their master data (esp. name, address, means of communication) and payment data (esp. account details) and keep them up to date until completion of the transaction, including the expiry of the warranty periods. If master data changes after the order is completed, the Customer must inform the Seller of the change immediately.
(3) The Customer must ensure that the email address provided for order processing is correct so that emails sent by the Seller can be received at this address. 12 Force majeure
(1) In the event of force majeure events that affect the fulfillment of the contract, the Seller is entitled to postpone the delivery for the duration of the hindrance and, in the event of longer-term delays, to withdraw from the contract in whole or in part, without any claims against the Seller being derived therefrom.

- in the event of intentional or negligent injury to life, body, or health,
- due to a guarantee promise, unless otherwise regulated in this regard,
- due to mandatory liability such as under the Product Liability Act.
(3) If the Seller negligently violates a material contractual obligation, liability is limited to the foreseeable damage typical for the contract, unless liability is unlimited according to the preceding paragraph. Material contractual obligations are obligations which the contract imposes on the Seller according to its content to achieve the purpose of the contract, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the Customer may regularly rely.
(4) Otherwise, any liability of the Seller is excluded.
(5) The above liability provisions also apply with regard to the Seller's liability for their vicarious agents and legal representatives.

15 Data protection
(1) The Seller collects and processes the Customer's personal data to carry out the order.
(2) Further information on the handling of personal data by the Seller can be found in the data protection information at https://muwana.de

16 Choice of law, place of performance, place of jurisdiction
(1) For all legal relationships between the Seller and the Buyer arising from and in connection with these General Terms and Conditions, the law of the Federal Republic of Germany applies exclusively, excluding the UN Sales Convention (CISG). For consumers, this choice of law only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
(2) The place of performance for the Seller's services is their place of business.
(3) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from this contract is the Seller's place of business. The same applies if the Customer has no general place of jurisdiction in Germany or the EU or if their residence or habitual place of abode is not known at the time the action is filed. The authority to also call upon the court at another statutory place of jurisdiction remains unaffected.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this reimbursement.

Information on the Battery Act

Notes on battery disposal

In connection with the sale of batteries or the delivery of devices containing batteries, we are required to draw your attention to the following:

1. Free return of waste batteries Batteries must not be disposed of with household waste. You are legally obligated to return waste batteries to ensure proper disposal. You can return waste batteries free of charge to a municipal collection point or to a local retailer. As a distributor of batteries, we are also obligated to take back waste batteries, although our obligation is limited to waste batteries of the type that we carry or have carried in our range as new batteries. You can therefore send waste batteries of the aforementioned type back to us with sufficient postage.

2. Meaning of the battery symbols: Batteries are marked with the symbol of a crossed-out wheeled bin.

This symbol indicates that batteries must not be disposed of with household waste. For batteries containing more than 0.0005 percent by mass of mercury, more than 0.002 percent by mass of cadmium, or more than 0.004 percent by mass of lead, the chemical name of the pollutant used is indicated below the bin symbol:

Pb: Battery contains lead
Cd: Battery contains cadmium
Hg: Battery contains mercury
